Webinar Recording: Ontario Excess Soil Regulation

In December 2019, the Ministry of Environment, Conservation and Parks released a new regulation under the Environmental Protection Act, titled “On-Site and Excess Soil Management” (Ontario Regulation 406/19) to support improved management of excess construction soil. This Regulation was created to support proper management and re-use of excess soils and to ensure re-usable soil was not going to landfills as “waste”.

The Regulation took effect on January 1, 2021, and will be phased in over several years. Although the next phase is not until January 2022, some municipalities are already demanding the Jan 1, 2022 requirements be followed even though they aren’t mandatory yet.
